Update

We figured it was time for an update. We've known this for a while, but - for the same reason that we date our posts, we received a refresh of information confirming nothing has changed in this respect:

If you are unable to serve a company's statutory agent (stat agent), you can serve the company via the corporation commission. However, you still have to include the process server's affidavit of due diligence:

"From: Lynda Griffin (lgriffin@azcc.gov) on behalf of RECORDS Corp (RECORDS.Corp@azcc.gov)
Sent: Tue 6/14/11 5:12 PM

Dear Sir/Madam

Thank you for submitting your question via our web server.

At this point you may choose to serve the Corporation Commission. In order to do that effectively you will need the following:
1. Two copies of the summons
2. Affadavit of attempted service
3. Processing Fee of twentyfive dollars

That should be sent or hand delivered to the address listed below.
Arizona Corporation Commission
1300 W. Washington Ave. Rm 101
Phoenix, AZ 85007

If further questions contact our Call Center @ (602) 542-3026 so we may continue to assist you."

So, there you have it. A refresher in getting it done. Get those companies served today. Don't wait any longer. Good luck!
